인권위, ‘피의사실공표와 인권침해’ 주제로 공청회 개최 국가인권위원회(위원장 조영황)는 2005년 7월 1일 오후 2시부터 5시 30분까지 국가인권위원회 11층 배움터에서 학계, 언론계, 법조계, 수사기관 등 각계 전문가를 초청하여 ‘피의사실공표와 인권침해’를 주제로 공청회를 개최합니다. 국가인권위는 수사기관에 의해 공판청구 전에 피의사실이 공표됨으로써 개인의 인격권 및 초상권이 침해되는 사례가 반복되고 있으나 이에 대한 적절한 제재장치가 미흡하였다는 판단 하에, 2004. 11. 11. 안상수 인천시장 굴비상자사건, 불량만두소 사건, 연예인 병역비리 사건을 피의사실공표로 인한 인권침해의 대표적인 사례로 선정하여 직권조사 결정을 한바 있습니다. 이번 공청회는 직권조사를 마무리 하는 과정에서 피의사실공표 문제에 직․간접적으로 관여하고 있는 여러 관련기관, 전문가, 그리고 피해자들의 의견을 청취하고 피의사실공표로 인해 발생하는 문제점에 대한 개선책을 마련해 보고자 하는 취지에서 마련되었습니다. 이날 공청회에서는 전지연 교수(연세대 법학과)의 사회로 △김기창 교수(고려대 법학과)의 주제발표 △박주선 전 국회의원, 통조림 포르말린 사건 피해자인 김진흥 前 한샘식품 대표의 피해사례 발표 △ 이재진 교수(한양대 신방과), 이현종 기자(문화일보), 김환수 판사(서울고법), 곽규택 검사(대검 검찰연구관), 표창원 교수(경찰대), 신현호 변호사(대한변협 교육이사)의 지정토론이 있을 예정입니다. 국가인권위원회는 이번 공청회 결과를 토대로 피의사실공표로 인해 발생하는 인권침해 문제점에 대한 개선책을 마련하는 등 수사기관 등에 의해 국민의 인권이 침해되는 사례가 없도록 지속적인 노력을 해나갈 것입니다. 끝.

President Roh Moo-hyun on Thursday appointed Justice Minister Kim Seung-kyu to head the National Intelligence Service (NIS), Chong Wa Dae said Thursday.
``We thought him the best man to lead innovation within the NIS and help it become an organization distant from power and politics, based on his stable management style and fine character,’’ Kim Wan-key, senior presidential secretary for personnel affairs, told reporters.
Kim will replace Ko Young-koo, who offered to resign last month citing health reasons, as NIS director.
The new justice minister will likely be named next month when Kim Seung-kyu takes office as NIS director, according to Kim Wan-key.
The presidential secretary, however, said he has not received any order nor is he preparing for any other Cabinet reshuffle.
``As far as I know, the foreign policy and security lines of the Cabinet and the presidential office will remain as they are for the time being,’’ he added.
Justice Minister Kim has to pass a confirmation hearing at the National Assembly’s Intelligence Committee for his new position at the national spy agency. Kim, 61, passed a hearing at the committee when he was appointed justice minister last July.
Born in Kwangyang, South Cholla Province, Kim Seung-kyu graduated from the law department of Seoul National University in 1968.
After working as a prosecutor for about 15 years, Kim briefly served as vice justice minister in 2001. He then became the director of local prosecution offices and also worked as a representative of a law firm.
He has led the ``reform’’ within the prosecution since he was appointed justice minister, following his predecessor Kang Kum-sil.

Justice Minister Kim Seung-kyu has emerged as the most competent candidate for new director of the National Intelligence Service (NIS), Chong Wa Dae officials said on Wednesday.
Observers speculate this might lead to a reshuffle of Cabinet ministers and presidential secretaries next month as a measure to help refresh the Roh Moo-hyun administration, which entered its third year last February.
Some ruling party members have called for a reshuffle of the government following the party’s defeat in the by-elections on April 30.
The top post at the spy agency has remained vacant since Ko Young-koo, 68, stepped down citing health reasons last month.
On Tuesday, Kim Woo-sik, presidential chief of staff, met the justice minister over dinner to sound him out, sources at Chong Wa Dae said. The justice minister had just returned from a visit to Brazil on the occasion of the Global Forum on Fighting Corruption. The justice minister, however, has yet to officially accept the offer.
Kim Seung-kyu, 61, served at the prosecution for about 15 years until he was appointed vice justice minister in 2001. After that, Kim served as director of local prosecution offices and briefly worked as a lawyer until he was named justice minister in July last year.
Following his predecessor Kang Kum-sil, Justice Minister Kim has been on the front of ``reform’’ within the prosecution since he took office. But the discord within the prosecution regarding the reform measures presented by the Presidential Committee on Judicial Reform remains unresolved.
The presidential office had initially considered National Security Advisor Kwon Jin-ho, former Unification Minister Jeong Se-hyun and former Minister of Foreign Affairs and Trade Yoon Young-kwan as likely candidates for NIS chief, according to the sources.
But Kim Seung-kyu scored higher marks for having served as justice minister and coming from Kwangyang in South Cholla Province.
Currently, Prosecutor-General Kim Jong-bin is also from the southwestern part of the country.
Huh Joon-young, commissioner-general of the National Police Agency, is from North Kyongsang Province and Lee Ju-sung, commissioner of the National Tax Service, from South Kyongsang Province, both of which lie in the nation’s southeastern part.
Rivalry between the two regions has been one of the deciding factors in naming senior government officials in South Korea.
If Kim Seung-kyu gets the recommendation from a Chong Wa Dae personnel affairs meeting, President Roh will likely appoint him as new NIS director as early as today.
New justice minister and other new Cabinet ministers will have to pass National Assembly confirmation hearings under an agreement struck between the ruling and opposition parties earlier this month.

청와대는 당초 후임 국정원장에 권진호(權鎭鎬) 청와대 국가안보보좌관이 유력하다고 밝혔지만, 곧바로 “대통령의 선택폭을 넓힐 필요가 있다”며 검토대상 후보군을 확대시키기 시작했다.
초기에 권 보좌관과 정세현(丁世鉉) 전 통일부장관이 유력한 후보군으로 검증이 진행되었고, 시간이 흐르면서 윤영관(尹永寬) 전 외교부장관까지 검토대상에 합류됐다.
이에 따라 청와대는 당초 지난 2일 인사추천회의후 내정자를 발표키로 했으나, 9일로 연기했고, 이날 회의도 결론을 짓지 못하는 등 회의 연기를 거듭했다.
노무현(盧武鉉) 대통령이 한미정상회담을 위해 미국으로 출국하기 직전 열린 청와대 인사추천회의에서는 “새로운 인물도 물색할 필요가 있다”는 결론에 따라 기존 3명 후보외에 ’α’의 후보를 찾아나섰다.
김승규장관은 지난 주말을 거치면서 유력한 후보로 부상했고, 김우식(金雨植) 비서실장이 브라질 반부패회의 참석 출장을 마치고 14일 귀국한 김 장관을 이날 밤 곧바로 면담, 국정원장 인선문제를 상의한 것으로 확인됐다.
청와대 당국자는 15일 “한미정상회담후 김 장관이 본격적으로 검토된 것으로 알고 있다”며 “참여정부의 철학을 잘 알고 있고, 법무장관을 수행하며 능력이 검증된데다 국정원 개혁을 추진할 적임자라는 평가가 점수를 받고 있다”고 말했다.
김 장관을 국정원장으로 기용할 경우 차기 국정원의 ’컬러’가 기존에 검토되던 후보군들이 국정원장으로 갈 경우와는 다를 수밖에 없고, 더불어 후속 인선의 방향에도 큰 변수로 작용할 전망이다.
이는 노 대통령의 국정 운용 구상의 변화와도 맞물려 김 장관의 국정원장 유력후보 부상은 비상한 관심을 끌지 않을 수 없다.
김 장관은 지난해 7월 강금실(康錦實) 장관의 바통을 이어받아 검찰개혁을 진두지휘해왔다는 점에서 현 시점에 국정원장으로의 자리 이동은 여러가지 포석을 염두에 둔 것이라는 해석이 나오고 있다.
특히 사법개혁추진위원회의 사법개혁안을 놓고 검찰내 반발이 제기되는 등 검찰개혁 현안이 매듭지어 지지 않은 상태이다.
일각에서는 노 대통령의 신뢰를 바탕으로 검찰개혁을 추진해온 김 장관의 임명으로 국정원의 기조가 바뀌는게 아니냐는 관측도 나오고 있다.
청와대 관계자는 그러나 “탈(脫) 권력, 탈 정치화라는 국정원의 기조가 바뀌는 것은 아니다”며 “국정원의 제자리 찾기라는 차원에서 법조 출신이 적임이라고 보고 있는 것”이라고 말했다.
아울러 김 장관이 국정원장으로 발탁될 경우 후임 법무장관 인선이 불가피해 참여정부 임기 중반 분위기 쇄신을 위한 대폭 개각으로 확대될 가능성과 결부지어 주목된다.
추가 개각 가능성에 대해 청와대 관계자는 “두고 봐야 한다”며 가능성을 열어놓았다.
4.30 재.보선 참패 이후 여당 일각에서 제기된 인적 쇄신 요구를 반영하는 차원에서 국정원장 인사청문회가 마무리된 후 7월쯤 내각과 청와대를 포함한 여권 진용의 개편이 단행될 가능성이 높다는 관측이 힘을 얻고 있다.
이런 가운데 여야는 지난 10일 국회 인사청문회 대상 고위공직자를 전 국무위원으로 확대키로 합의한 바 있어 이번 임시국회에서 관련법 개정이 이뤄질 경우 후임 법무장관은 물론 7월 부분 개각이 이뤄질 경우 후임 장관들은 모두 국회 인사청문회를 거쳐야 한다.
이와 함께 김 장관이 국정원장 유력 후보로 부상한 것은 최근 정국 상황 등을 감안, 호남 출신이라는 지역 요인도 고려됐을 것이라는 관측도 있다.
전남 광양출신의 김 장관이 국정원장으로 기용될 경우 현재 국회 인사청문회 대상인 ’빅 4’ 권력기관장의 지역출신 분포는 전남 출신인 김종빈(金鍾彬) 검찰총장, 경북 출신 허준영(許准榮) 경찰청, 경남 출신 이주성(李周成) 국세청장으로 호남 2, 영남 2명의 구도가 된다.
한편 후임 법무장관에는 열린우리당 원내대표를 지낸 전남 목포 출신의 천정배(千正培) 의원의 발탁설도 흘러나오고 있으나 이 경우 법무장관과 검찰총장이 모두 호남출신이 차지하게 된다는 점에서 가능성을 낮게 보는 관측도 있다.

The chief of the nation's spy agency Ko Young-koo has tendered his resignation because of health reasons and President Roh Moo-hyun is likely to accept, a Cheong Wa Dae official said yesterday.

Cheong Wa Dae officials emphasized Ko's resignation is strictly due to health reasons and denied all suggestions that it may be linked to other issues.

The resignation was offered last week after the National Intelligence Service probing committee issued a mid-investigation report on the mysterious disappearance and death in 1979 of Kim Hyung-wook, the former chief of the Korean Central Intelligence Agency, predecessor of the NIS.

The spy agency reported that Kim was kidnapped and murdered in Paris by two foreigners hired by the KCIA and the assassination order may have come from President Park Chung-hee, the late father of the opposition Grand National Party chairwoman Park Geun-hye. The GNP immediately criticized the timing of the report as political motivated.

Ko told the president in his resignation offer that he could now hand his job over to a newcomer as the agency had begun to produce tangible results in its probe of unresolved cases of the past, the official said.

The NIS chief, who took up the job in April 2003 two months after Roh became president, has repeatedly expressed his intention to step down since last year.

Some lawmakers presumed Ko's resignation might have been influenced by the ruling Uri Party's dissatisfaction that he and the NIS had failed to disclose the connection between Kim Jae-bok, president of Haengdam Island Development Co., and the current scandal over the project to develop an oceanic entertainment complex on the island.

Some Uri lawmakers demanded Ko's resignation last year, apparently dissatisfied that the NIS had not provided sufficient information on domestic politics to help the party ahead of the vote in the April general elections early in the year. As it happened, Uri emerged as the majority party in those elections because of the backlash against the GNP for pushing through an impeachment motion against Roh that was later overturned by the Constitutional Court.

Acknowledging that the NIS had been notorious for conducting political investigative activities for the benefit of the government and the ruling party under the past dictatorial administrations, Ko had pledged not to interfere in domestic politics and focus only on collecting security information and tracking down industrial spies.

Since Ko's resignation comes at a time when Uri is calling for reform of the agency to activate information exchanges between the government and the ruling party, sources say it will likely bring some major changes to the NIS.

Ko will stay in the post until his successor passes a parliamentary confirmation hearing.

Sources say National Security Adviser Kwon Chin-ho is among candidates favored by Roh to replace Ko and conduct efficient reform of the agency.

高국정원장, 물러났나 밀려났나…사퇴배경 논란 새 국가정보원장으로 기용될 권진호(權鎭鎬) 대통령국가안보보좌관은 청와대 내에서는 지난해 6월경부터 차기 국정원장 후보 중 1순위로 꼽혀 왔다.
지난해에는 국정원 과거사진상규명작업을 본궤도에 올려놓기 위해 시민단체와 밀접하게 교감할 수 있는 재야 변호사 출신의 고영구(高泳耉·사진) 원장이 훨씬 적임자라는 판단 때문에 교체 인사가 미뤄져 왔다.
권 보좌관은 육사 19기 출신으로 국군정보사령관, 국정원 1차장을 지낸 정보통이다. 지난해 1월 대통령국가안보보좌관에 기용된 뒤 1년 5개월 동안 청와대에서 근무해 노무현(盧武鉉) 대통령의 의중을 파악하는 데도 밝다. 권 보좌관은 이해찬(李海瓚) 국무총리와 같은 서울 용산고 출신이기도 하다. 또한 충남 금산 출신이어서 지역적으로는 이 총리, 김우식(金雨植) 대통령비서실장과 함께 ‘빅3’를 충청 출신이 석권하는 결과가 된다.
11일로 예정된 한미정상회담을 앞두고 현재 미국을 방문 중인 권 보좌관은 지난달 31일 미국으로 떠나기 직전에 노 대통령으로부터 내정 통보를 받은 것으로 알려졌다.
국가안전보장회의(NSC) 사무처장을 겸하고 있는 권 보좌관이 국정원장으로 자리 이동을 하게 됨에 따라 외교안보 라인의 변화와 함께 이종석(李鍾奭) NSC 사무차장의 거취에도 관심이 쏠리고 있다.
한편 지난달 20일경 노 대통령에게 사의를 표명한 고 원장의 사퇴 배경을 둘러싸고 정치권 안팎에서는 갖가지 설이 난무하고 있다. 먼저 국정원 과거사 진상규명작업을 추진하는 과정에서 국정원 내부의 반발과 시민단체 쪽의 압박을 견디지 못하고 물러난 것이라는 분석이 있다.
여권 내에서는 국정원이 최근 불거진 행담도 개발사업 문제를 미리 파악하지 못하는 등 정보기관으로서 제 역할을 못하고 있다는 불만도 제기됐다. 러시아 유전개발사업 의혹사건과 관련해 2004년 7월 국정원 직원들이 김세호(金世浩) 당시 철도청장과 우리은행장 간의 모임에 참석한 사실이 드러난 게 문제가 됐으리라는 얘기도 있다.
그러나 청와대 관계자는 “지난해부터 고 원장이 적절한 시점에 그만두겠다는 뜻을 내비쳐 왔다”며 예고된 사퇴임을 강조했다. 실제로 청와대는 고 원장 후임 인선 문제를 지난해 말부터 은밀히 검토해 왔고 한때 반기문(潘基文) 외교통상부 장관도 검토 대상에 올랐다.

South Korea’s intelligence chief has tendered his resignation, citing health reasons, according to informed sources yesterday. President Roh Moo-hyun will likely accept the resignation soon when he selects a candidate for the post, a Chong Wa Dae official said.

Ko Young-koo, 68, director of the National Intelligence Service (NIS), delivered his intention to step down to Roh last week, when an ad hoc panel of the NIS released interim results of its investigation of the organization’s past misdeeds.

Chong Wa Dae officials said that although Ko cited health problems, it also comes as the reform process of the NIS has gotten on track since its director’s inauguration two years ago.

Ko, who once led ``Minbyon,’’ an association of relatively progressive lawyers, was picked up by Roh, also a former human rights lawyer who wanted to overhaul the intelligence agency that was largely a ``political maid’’ of previous authoritarian governments.

He was deemed so progressive that the main opposition Grand National Party (GNP), representing the nation’s conservative forces, threatened to disapprove the appointment at the National Assembly in early 2003.

Although he repeatedly expressed his intention to quit last year, the NIS chief was each time requested to stay until the fact-finding committee began its full-fledged inquiry into several suspicious cases under the previous governments, according to his aides.

In a rare move, Roh reconfirmed his confidence in Ko last September, saying he has ``never thought of replacing’’ the NIS director.

Ko will likely continue in office until his successor has passed a parliamentary confirmation hearing. Currently, National Security Adviser Kwon Chin-ho is among the most likely candidates to fill the post, according to sources at Chong Wa Dae.

Kwon has been favored as NIS director ever since last year when news of Ko’s possible resignation was reported by local news media. Roh, according to Chong Wa Dae officials, believes Kwon is able to successfully take up the unfinished work of reforming the spy agency.

Some ruling party lawmakers and government officials called for Ko’s replacement in April last year immediately after the National Assembly elections, apparently displeased with the NIS’ provision of no sufficient information to help the ruling party ahead of the elections.

As part of efforts to erase the image of the NIS notorious for political maneuvering during previous authoritarian governments, Ko pledged not to interfere with domestic politics since taking office. He said the agency will focus instead on collecting information on security from abroad and tracking down industrial spies, as well as collecting intelligence on North Korea.

등록 일자 : 2005/06/01(수) 08:45고영구(高泳耉·68) 국정원장이 최근 노무현(盧武鉉)대통령에게 사의를 표명한 것으로 1일 알려졌다. 노 대통령은 조만간 고 원장의 사의를 받아들여 사퇴서를 수리하고, 후임 국정원장 내정자를 발표할 것으로 전해졌다.
청와대 관계자는 "고 원장이 지난 26일 국정원 과거사 진실규명위원회의 김형욱사건 등 1차 발표 시점을 전후해 노 대통령에게 사의를 표명했다"고 말했다.
이 관계자는 "고 원장은 작년부터 사의를 표명했으나 과거사 규명 작업이 궤도에 오를 때까지 국정원장직을 수행키로 정리됐었다"며 "최근 과거사 규명 작업의 가시적인 성과들이 나오고 있어 이번에 사의를 밝힌 것"이라고 말했다.
고 원장의 사의 배경과 관련, 이 관계자는 "건강상의 이유"라며" 본인이 휴식을 취하고 싶다는 뜻을 전했다"고 말했다.
고 원장은 68세로 지난 2003년 4월말 취임, 2년여에 걸쳐 국정원장으로 일해 왔다.
청와대는 이에 따라 이른 시일내 고 원장의 사표를 수리, 후임 내정자를 발표한 후 이달 임시국회에서 국정원장 내정자 인사청문회 절차를 거쳐 후임 국정원장을 정식 임명한다는 방침이다.
고 원장은 후임자가 인사청문회 절차를 거쳐 정식 임명될 때까지 국정원장 직무를 수행한다.
후임 국정원장으로는 권진호(權鎭鎬) 청와대 국가안보보좌관 등이 물망에 오르는 것으로 전해졌다.
